GUEST INFORMATION

At Wild Canyon Adventures we stress the importance of privacy and are committed to earning the trust of our guests by adopting high standards for the protection of personal information.

Our policy outlines the type of personal information we collect and receive, the circumstances in which we collect or receive personal information, the policies and procedures we have established outlining its use and storage, and for sharing certain types of personal information in certain limited circumstances, the procedures you should follow if you have any questions or requests in respect of your personal information or our policies and procedures and the person to whom such questions or requests should be directed, and the means by which to communicate with that person.

In this policy, personal information means information about you that is personally identifiable like your name, address, e-mail address or phone number, and that is not otherwise publicly available and is not part of your work identification.

It also includes information on guest preferences and usage, when such information is supplied to or recorded by Wild Canyon Adventures in the course of transacting business with an individual.

The Privacy Protection Policy does not apply to information regarding Wild Canyon Adventures corporate customers. However, such information is protected by other Wild Canyon Adventures policies and practices and through contractual arrangements.

HOW YOU MAY PROVIDE US YOUR PERSONAL INFORMATION

  1. By making a reservation or by using Wild Canyon Adventures services.
  2. By providing it to us in communications regarding service delivery such as comment cards.
  3. By providing the information to us by participating in a marketing initiative.
  4. By visiting our website.

Below we will outline the type of information normally collected in each of these circumstances, the reasons for doing so, how we will use it and store it.

MAKING A RESERVATION

When making a reservation or using Wild Canyon Adventures services it is necessary to have information in order to identify you, contact you and to process your purchase and requests. This information usually includes your name, address, phone number, e-mail address, credit card number and expiration date, and language preference. It may also include, if you choose to share that information with us, your preferences regarding the delivery of your service such as type of food, type of harness, and the like. You may wish to have your purchase of Wild Canyon Adventures' services recognized in a third party's loyalty program with which Wild Canyon Adventures has a relationship. To do so will require you providing us certain verification information such as your membership number in the third party program or your reservation code given by them. We also offer special discounts from time to time that may have qualifying criteria. Sometimes we offer special offers to, for example, seasonal or for children. To assess your eligibility and process your reservation correctly, we need to record your date of birth at the time of booking. You may be required to provide personal identification with your date of birth in order to verify this upon check-in.

Wild Canyon Adventures, is a family of management companies that manage hotels and parks for third party owners. Your personal information is shared with the third party owner of the park where you intend to do your tour and those of its employees involved in delivering the service to you to the extent necessary for them to do so and to process the transaction. All parks that are managed by Wild Canyon Adventures are required agree to abide by the terms of this Privacy Protection Policy.

From time to time, we offer packages or other services that involve third parties. If you are partaking of such a package or service your personal information will be shared with that third party to the extent necessary to provide that service and process the purchase or request.

Wild Canyon Adventures may use the information you provide to send you offers and information about Wild Canyon Adventures and those of select third parties. Your information will not be given to these third parties but rather the offer of the third party will be provided to Wild Canyon Adventures which will manage the distribution.

If you do not wish to receive such offers and information you may unsubscribe or opt-out by sending an email to groups@wildcanyon.com.mx, using the subject line "Unsubscribe", so indicating your request with sufficient personal identifiers so we can appropriately act on your request. All our marketing communication of this type will also contain instructions for unsubscribing.

INFORMATION PROVIDED TO US IN COMMUNICATIONS REGARDING SERVICE DELIVERY SUCH AS COMMENT CARDS

Information provided to us in such a fashion will be used solely for the purpose of recording your comments, communicating with you in respect of them, reviewing them with the subject park and park personnel, for the purposes of recognizing employees for excellence of service delivery and for developing improvements in service delivery.

WHY WE COLLECT PERSONAL INFORMATION

  1. To establish and maintain a responsible commercial relationship with you and to provide ongoing service.
  2. To understand your needs and preferences. We maintain a record of the products and services you receive from us and we may ask for additional information so that we can serve you better.
  3. To develop, enhance, market or provide products and services. For example, we look at our guests' use of our services so that we can better understand how to improve our services.
  4. To manage and develop our business and operations. For example we analyze guest patterns of usage of our parks and services to help us manage them efficiently and plan for future growth.
  5. To meet legal and regulatory requirements.

WHEN DO WE DISCLOSE PERSONAL INFORMATION

We disclose personal information only in these limited circumstances:

  1. We may disclose a guest's personal information to a person who, in the reasonable judgment of Wild Canyon Adventures, is seeking the information as an agent of the guest - for example, a travel agent who is booking a reservation on behalf of the guest.
  2. Personal information will be shared with the Wild Canyon Adventures Park whole sale clients for which your reservation has been made so that they may provide the services you have reserved.
  3. Personal information may be shared with other Wild Canyon Adventures suppliers so that they may better provide services to you in the event you wish to travel in the future.
  4. Personal information will be shared with a third party involved in supplying the guest with the services they have purchased to the extent necessary to effect the supply and the processing of the transaction.
  5. Personal information may be shared with a third party retained by Wild Canyon Adventures Parks to perform functions on its behalf such as reservations handling, data processing or storage, guest surveys or research.
  6. Personal information may be shared with an agent retained by Wild Canyon Adventure to evaluate a customer's credit worthiness or in order to collect a customer's account.
  7. Personal information may be shared with a public authority or an agent of public authority if in the reasonable judgment of Wild Canyon Adventure it appears that there is an imminent danger to life or property which could be avoided or minimized by disclosure of the information, or which disclosure is compelled by legal authority.

Any such disclosure of a guest's personal information by Wild Canyon Adventures Paks to a third party will be made only on a confidential basis conditioned upon the information being used only for the purpose for which it has been disclosed.

BY VISITING OUR WEBSITE

We use "cookies" on our website. Cookies are pieces of information that an Internet site transfers to your hard drive for record-keeping purposes. The use of cookies is an industry standard -- you'll find them almost everywhere on the Internet. Wild Canyon Adventures uses cookies to recognize visitors when they return to our sites. Once we know it's you, we can customize your online visit.

We may also evaluate our content and services and tailor our websites, for visitors, based on other information we collect such as IP addresses, which are numbers assigned to your computer whenever you use the Internet, pixel tags (or clear gifs), and the type of Internet browser or operating system you are using. This information is collected in the aggregate, but we may tie it to your personal information through cookie use as described above.

USE OF CONTENT

All information, materials, functions and other content (including Submissions ("Content") contained on Wild Canyon Adventures Site are our copyrighted property. All trademarks, service marks, trade names, and trade dress are proprietary to us. We may change the Wild Canyon Adventures Site or delete Content or features at any time, in any way, for any or no reason.

Except as we specifically agree in writing, no Content from Wild Canyon Adventures Site may be used, reproduced, transmitted, distributed or otherwise exploited in any way other than as part of the Wild Canyon Adventures Site, except that where a Wild Canyon Adventures Site is configured to enable the download of particular Content, you may download one copy of such Content to a single computer for your personal, noncommercial home use only, provided that you (a) keep intact all copyright and other proprietary notices, (b) make no modifications to the Content, and (c) do not use the Content in a manner that suggests an association with any of our products, services or brands. Any business use, "re-mailing" or high-volume or automated use of Wild Canyon Adventures Site is prohibited.

PUBLIC FORUMS AND COMMUNICATION

"Public Forum" means an area, site or feature offered as part of our Web Site that offers the opportunity for users to Distribute Submissions for viewing by one or more Wild Canyon Site users, including a chat area, message board, instant messaging, mobile messaging, social community environment, profile page, conversation page, blog, e-mail function (including electronic greeting cards and send-a-friend e-mails).

You acknowledge that Public Forums and features offered therein are for public and not private communications, and you have no expectation of privacy with regard to any Submission to a public Forum. We cannot guarantee the security of any information you disclose through any of these media; you make such disclosures at your own risk.

You are and shall remain solely responsible for the Submissions you Distribute on or through Wild Canyon Adventures site under your username or otherwise by you in any Public Forum and for the consequences of submitting and posting same. We have no duty to monitor any Public Forum.

Also, you should be skeptical about information provided by others, and you acknowledge that the use of any Submission posted in any Public Forum is at your own risk. For example, we are not responsible for, and we do not endorse, the opinions, advice or recommendations posted or sent by users in any Public Forum and we specifically disclaim any and all liability in connection therewith.

We owe you no obligation, and therefore may refuse, to post, deliver, remove, modify or otherwise use or take any action with respect to Submissions you Distribute.

COOPERATION; REMOVAL OF SUBMISSIONS

We reserve the right, but disclaim any obligation or responsibility, to (a) refuse to post or communicate or remove any Submission from our site.

LIMITATION OF LIABILITY

UNDER NO CIRCUMSTANCES, INCLUDING NEGLIGENCE, SHALL WE, OUR RESPECTIVE RESELLERS, DISTRIBUTORS, SERVICE PROVIDERS OR SUPPLIERS, BE LIABLE TO YOU OR ANY OTHER PERSON OR ENTITY FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES INCLUDING LOST PROFITS, PERSONAL INJURY (INCLUDING DEATH) AND PROPERTY DAMAGE OF ANY NATURE WHATSOEVER, THAT RESULT FROM (A) THE USE OF, OR THE INABILITY TO USE, WILD CANYON ADVENTURES SITE OR CONTENT, OR (B) THE CONDUCT OR ACTIONS, WHETHER ONLINE OR OFFLINE, OF ANY USER OF A WILD CANYON ADVENTURES SITE OR ANY OTHER PERSON OR ENTITY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES AND CAUSES OF ACTION WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE EXCEED THE AMOUNT PAID BY YOU, IF ANY, OR $100 USD(WHICHEVER IS LESS) FOR ACCESSING OR PARTICIPATING IN ANY ACTIVITY RELATED TO WILD CANYON ADVENTURES SITE. MOREOVER, UNDER NO CIRCUMSTANCES SHALL WE, OUR RESPECTIVE RESELLERS, DISTRIBUTORS, SERVICE PROVIDERS OR SUPPLIERS, BE HELD LIABLE FOR ANY DELAY OR FAILURE IN PERFORMANCE RESULTING DIRECTLY OR INDIRECTLY FROM AN ACT OF FORCE MAJEURE OR CAUSES BEYOND OUR OR THEIR REASONABLE CONTROL.

WE MAY TERMINATE YOUR FURTHER ACCESS TO WILD CANYON ADVENTURES SITE OR CHANGE THE WILD CANYON ADVENTURES SITE OR DELETE CONTENT OR FEATURES IN ANY WAY, AT ANY TIME AND FOR ANY REASON OR NO REASON.

THE LIMITATIONS, EXCLUSIONS AND DISCLAIMERS IN THIS SECTION AND ELSEWHERE IN THESE TERMS OF USE APPLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. AMENDMENT

At any time, we may amend these terms of use (including by modification, deletion and/or addition of any portion thereof). If we make a material amendment to these terms of use, we will notify you of such amendment by sending you an e-mail at the last e-mail address that you provided us, and/or by posting notice of such amendment on the Web site covered by these terms of use. Any such amendment to these terms of use will be effective thirty (30) calendar days following either our dispatch of an e-mail notice to you or our posting of notice of the changes on the Web Site.
